Anthony J. Sposaro Biography
Anthony J. Sposaro has been practicing law since 1977 and is recognized a leading attorney in the area of farm law. He is intimately familiar with the Right to Farm Act and the protection it provides farmers from government regulation, civil claims and criminal prosecution. He has represented farmers throughout the State in:
- Complaints brought by municipalities alleging zoning and health code violations
- Response to demands to submit variance and site plan applications to land use boards
- Complaints brought by neighbors
- Complaints brought by the NJDEP
- Applications for site specific agricultural management practice approval before County Agriculture Development Boards and the State Agriculture Development Committee
- Appeals from the denial of farmland assessment
- The sale of development rights
- Condemnation proceedings
In the landmark case of Gasko v. Monroe Township, Mr. Sposaro had lower court rulings overturned and convinced the New Jersey Supreme Court to reinstate farmland assessment for temporary greenhouses used to both grow and sell plant material.
Mr. Sposaro's practice is not limited to farm law. He has significant experience in land use matters and has a long history of representing developers and land use boards as well. Over the last twenty years he has represented the Mount Olive Township Planning Board, Chester Township Zoning Board of Adjustment, Lopatcong Township Planning Board and Zoning Board of Adjustment. He has secured land use approval for the construction of properties for banks, professional offices, shopping centers, churches, residential complexes and subdivisions. He also has successfully blocked the development of many such projects, including a multimillion dollar hotel complex in the case of Randolph v. Brigantine, that resulted in the resignation of the Planning Board Chairwoman for conflicts of interest. Mr. Sposaro has recently been appointed as the Attorney for the Mendham Township Zoning Board of Adjustment.
Mr. Sposaro represents buyers and sellers of real estate and handles a variety of transactional work, civil litigation related thereto and consumer fraud claims. He has also represented the interests of those who have suffered personal injuries resulting from automobile collisions, slip and falls, elevator and automatic door malfunctions and commercial fireworks, having recovered millions of dollars on their behalf.
He served as Senior Assistant Counsel to the New Jersey Casino Control Commission from 1979 to 1981. Mr. Sposaro received his undergraduate degree from Seton Hall University. He graduated from the University of Dayton School of Law where he was the Articles Editor for the Law Review. Mr. Sposaro is a member of the New Jersey State Bar Association and Morris County Bar Association as well as its Land Use Section.
